Terms of Service

1. Acceptance of Terms

Welcome to Booking Minds. By accessing or using our mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Booking Minds is a platform that connects professionals with individuals seeking on-demand meetings and consultations. Our Service enables:

  • Professionals to list their services and set hourly rates
  • Users to discover nearby professionals via an interactive map
  • Real-time negotiation of meeting terms and pricing
  • In-app messaging for meeting coordination
  • Secure payment processing for services rendered

Booking Minds acts solely as a platform to facilitate connections between users. We are not a party to any agreements made between professionals and clients.

3. Eligibility

To use Booking Minds, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information

By using the Service, you represent and warrant that you meet all eligibility requirements.

4. User Accounts

Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access

Account Responsibility

You are responsible for all activities that occur under your account. Booking Minds is not liable for any loss or damage arising from unauthorized use of your account.

5. User Conduct

When using Booking Minds, you agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Post false, misleading, or fraudulent information
  • Harass, threaten, or intimidate other users
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Collect user information without consent
  • Circumvent any fees owed to Booking Minds
  • Create multiple accounts for deceptive purposes

We reserve the right to suspend or terminate accounts that violate these Terms.

6. User-Generated Content and Zero-Tolerance Policy

Booking Minds enables users to create profiles, exchange messages, and submit content such as reviews, photos, and descriptions (collectively, "User-Generated Content" or "UGC"). By using the Service, you acknowledge and agree to the following End User License Agreement ("EULA") terms, which apply to all UGC and user interactions on the platform.

Zero Tolerance for Objectionable Content and Abusive Behavior

Booking Minds has zero tolerance for objectionable content or abusive users. You agree that you will not create, upload, post, transmit, share, or otherwise make available any content that is:

  • Sexually explicit, pornographic, or obscene
  • Hateful, discriminatory, or that incites violence against individuals or groups
  • Harassing, bullying, threatening, defamatory, or intimidating
  • Violent, graphic, or depicts harm to people or animals
  • Child sexual abuse material (CSAM) or any content that exploits minors
  • Fraudulent, deceptive, or misleading
  • Infringing on intellectual property or privacy rights of others
  • Spam, unsolicited advertising, or otherwise unlawful
  • Any other content a reasonable person would find objectionable

Users who engage in abusive behavior or post objectionable content will be immediately removed from the Service, and their accounts will be terminated.

Content Filtering

Booking Minds employs automated and manual content filtering to detect and remove objectionable content from the Service. We use a combination of keyword filters, image moderation, and human review to screen User-Generated Content before and after publication. Despite these measures, we cannot guarantee that all objectionable content will be detected automatically, which is why we rely on our user community to report any content that slips through.

Flagging Objectionable Content

Every user profile, message, image, and piece of User-Generated Content within the Booking Minds app includes a built-in "Report" or "Flag" mechanism. To flag content you believe is objectionable or violates these Terms:

  1. Tap the "Report" button (or ellipsis menu "⋯") associated with the content or user
  2. Select the reason for your report (e.g., harassment, inappropriate content, spam, fraud)
  3. Optionally provide additional details
  4. Submit the report

Reports are transmitted immediately to Booking Minds' moderation team for review.

Blocking Abusive Users

Booking Minds provides every user with the ability to block other users directly within the app. To block a user, tap the "Block" option on their profile or in the conversation menu. Once you block a user:

  • All content from the blocked user is removed from your feed and search results instantly
  • The blocked user can no longer message you, view your profile, or interact with you in any way
  • Booking Minds is automatically notified of the block and the associated content, which is then queued for moderation review

Our Response Commitment (24-Hour Action)

Booking Minds commits to reviewing and acting on every report of objectionable content or abusive behavior within 24 hours of receipt. Upon confirming a violation, we will:

  • Immediately remove the offending content from the Service
  • Eject the user who submitted the content by suspending or permanently terminating their account
  • Where appropriate, report the incident to relevant authorities
  • Take any additional steps necessary to prevent recurrence

Decisions made by Booking Minds regarding content removal and account termination are final. You may contact safety@bookingminds.app for questions about a moderation decision or to escalate an urgent safety concern.

User License for Content

You retain ownership of the content you submit. However, by submitting content, you grant Booking Minds a non-exclusive, worldwide, royalty-free license to host, use, display, reproduce, and distribute such content as necessary to operate the Service. You represent that you have all rights needed to grant this license and that your content does not violate the rights of any third party.

7. Professional Services

For Professionals

If you offer services through Booking Minds, you agree to:

  • Provide accurate information about your qualifications and expertise
  • Maintain any required licenses or certifications for your profession
  • Honor agreed-upon meeting terms and pricing
  • Conduct yourself professionally during all interactions
  • Comply with all applicable laws and professional standards

For Clients

If you book services through Booking Minds, you agree to:

  • Provide accurate information about your needs
  • Honor agreed-upon meeting terms and pricing
  • Treat professionals with respect
  • Pay for services rendered in accordance with agreed terms

8. Payments and Fees

Service Fees

Booking Minds charges the following fees:

  • Clients: 5% service fee on each booking
  • Professionals: 10% platform fee on earnings

Payment Processing

All payments are processed securely through Stripe. By using our payment features, you also agree to Stripe's terms of service. Booking Minds does not store your complete payment card information.

Payouts

Professionals receive payouts according to our standard payout schedule. We reserve the right to hold funds in cases of disputes or suspected fraud.

Refunds

Refund requests are handled on a case-by-case basis. If a meeting does not occur due to a professional's cancellation or no-show, clients are entitled to a full refund.

9. Meeting Negotiations

Our platform allows real-time negotiation between professionals and clients. Both parties may:

  • Accept the proposed terms
  • Reject the proposal
  • Submit a counter-offer

A binding agreement is formed only when both parties explicitly accept the terms. Until acceptance, either party may withdraw from negotiations without penalty.

10. Intellectual Property

The Booking Minds name, logo, and all related graphics, designs, and content are owned by Booking Minds and protected by intellectual property laws. You may not use, reproduce, or distribute our intellectual property without prior written consent.

By posting content on Booking Minds, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Booking Minds does not:

  • Guarantee the quality, accuracy, or reliability of any professional's services
  • Verify the credentials or qualifications of professionals (unless explicitly stated)
  • Guarantee that meetings will occur or be satisfactory
  • Warrant uninterrupted or error-free operation of the Service

Users engage with each other at their own risk. We encourage users to exercise caution and good judgment.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKING MINDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Your use or inability to use the Service
  • Any interactions or transactions between users
  • Unauthorized access to your data
  • Any third-party content or conduct

Our total liability shall not exceed the amount you paid to Booking Minds in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Booking Minds, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you post or submit

14. Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and associated data
  • Provisions that by their nature should survive will remain in effect

You may delete your account at any time through the app settings or by contacting us.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

  1. Informal Resolution: Contact us first to attempt to resolve the dispute informally.
  2. Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

You agree to waive any right to participate in class action lawsuits against Booking Minds.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Booking Minds operates, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
